General Terms & Conditions

The web store Outlet optika (hereinafter: store or Outlet optika) is operated by Optika Focus d.o.o. (hereinafter: supplier), which also offers products that are not available online.

'User' means any visitor accessing the web store Outlet optika.

The general terms and conditions set out the operation of the web store Outlet optika, the rights and obligations of the users and the store, and their mutual business relationship. Users can download the general terms and conditions to their computer by clicking the following link.



 

Prices

All prices contained in the web store are indicated in euros, include VAT and apply equally to all users.

The prices of the products will be as quoted on the website at the time the order is placed and shall not have a predetermined validity.

Prices indicated in the web store do not include shipping costs. 

 

Orders

An order placed by a user of the web store Outlet optika is considered as a concluded purchase contract.

A purchase confirmation is sent to the e-mail address registered by the user during the purchase process. The purchase notification is also stored by the supplier and may be forwarded to the user at his/her request.

The language used to place orders is Slovenian.

Order process

In order to buy an item in the web store, users simply click on the desired product to open its presentation page and add the item to their shopping cart.

The shopping cart contains all selected items.


Step-by-step checkout instructions:

Step 1 - Shopping cart review:

Shopping cart review - the user reviews the contents of his/her shopping cart and can remove any unwanted items by clicking the 'remove' button (waste basket icon).

Step 2 - Log in:

Log in - the user logs in to his/her account by entering his/her e-mail address and password provided during the registration process.

Registration - the user selects this option in order to create an account in the web store.

Purchase as guest - the user selects this option in order to buy an item without registering an account.

Step 3 - Your information:

By clicking 'Log in' during step 2 the user opens the page containing the information provided during registration. On this page the user can confirm or change the delivery address. After clicking 'Deliver to a different address' the user can tick off the option 'Use the same address for billing' and change the saved address by entering a new one in the fields displayed, or click 'Add new address' to enter a different shipping address.

Clicking 'Registration' during step 2 displays the fields into which the user enters the information required for a registration and an option to subscribe to the newsletter. After providing the required information, the user confirms the registration by clicking 'Registration'. Following a successful registration a new page opens in step 3, which contains the information provided during registration and an option to select the displayed address as the shipping address or to enter a different address. After clicking 'Deliver to a different address' the user can change the saved address by entering a new one in the fields displayed, or click 'Add new address' to enter a different shipping address.

Clicking 'Purchase as guest' during step 2 displays the fields into which the user enters the information required to conclude a purchase, and an option to subscribe to the newsletter and to enter the shipping address. The option to select a different billing address is also displayed. Ticking off 'Use a different billing address' displays the fields into which the user enters new information for billing.

Step 4 – Delivery method:

The user selects the delivery method. During this step the user confirms that he/she agrees with the general terms and conditions of the purchase.

Step 5 – Payment method:

The user selects the payment method and concludes the order.

During each step the user can change the provided information.

After completing the order, the user receives an e-mail containing the details of the order.

The customer or user can have the purchased items delivered by mail or collect them in person at the Optika Focus d.o.o. head office.

We use Pošta Slovenije to deliver the items by mail in accordance with their terms and conditions.


Delivery costs 

Delivery costs can be avoided by collecting the items at the Optika Focus head office.

Delivery costs for Slovenia:

Cost of delivery is 2,99€.

If you chose to pay upon delivery, Pošta Slovenije will charge you an additional fee for payment upon delivery in accordance with their rates. This fee is not included in the delivery cost; it is a separate cost of payment upon delivery.

Delivery costs for Croatia:

Cost of delivery is 4,50€.

Delivery costs for other states of European union:

Cost of delivery is 5,50€.

Payment method

During the order process the customer or user selects one of the following payment methods:

Upon delivery

Payment is made upon collection of the package. When using this method of payment you will be charged an additional fee by Pošta Slovenije based on their rates. Possible only for Slovenia.

Online banking service or based on a proforma invoice

By selecting this method the user is required to make the payment by transferring the amount to our trading account (SI56 0234 6025 7653 914). Information for payment using an online banking service:

Payment must be made within 7 days of the date of the order, otherwise the order will not be processed.

 

Payment at the head office

 

Payments can be made at the head office only if items are collected there.

 

PayPal

 

Payment via PayPal can be made once you complete your order. You will be redirected to the PayPal website where you can enter your e-mail address and PayPall password to log in to your account. Review the details of your order and confirm payment (Pay Now). After confirming the payment you will receive a notification stating whether the payment was successful. The payment process will thereby be completed.

 

Payment cards

 

Payments with Mastercard, American Express and Visa are made via PayPal. After completing your order you will be redirected to the PayPal website. There, you can choose to pay with your credit or debit card (Pay with my credit or debit card). Enter your personal and payment card information into the form.

Cancellation of orders and contracts  

The customer can cancel his/her order at any time before delivery.

Once the item has been delivered, the customer may cancel the order by notifying the supplier within 30 days of delivery. The customer is not required to provide a reason for the cancellation.

In the event of a cancellation the customer must comply with the provisions contained in the section Purchase guarantee.

 

Delivery deadline 

The delivery deadline is displayed on the presentation page of each item. The delivery deadlines differ depending on the item and manufacturer.


If an order is placed for several items with different delivery deadlines, the longest deadline shall apply (e.g. if an order is placed for an item with a 2-day delivery deadline and an item with a 7-day delivery deadline, the items will be delivered within 7 days).

100% purchase guarantee

Customers may enforce a guarantee only for items purchased in the web store Outlet optika.

We offer our customers a 100% satisfaction guarantee, which means that they can return the items within 14 days of receipt, thereby cancelling the purchase contract.

The returned items must be undamaged, unused and contained in their original packaging.

The costs of returning an item are covered by the customer.

The customer must provide a cancellation notice and include the current account to which the refund is to be made. Payments made in cash cannot be refunded. The customer will receive a full refund (for the price of the item and any delivery costs) within 14 days from the day on which we receive the returned items.

When enforcing a guarantee for items which are no longer sealed in their original packaging, the customer must provide a description of the defect or the reason for the claim, and return the item together with the original packaging and a copy of the invoice. The claim shall be forwarded to the product manufacturer. The manufacturer will decide whether or not the claim is justified.

The customer may enforce a guarantee for any item damaged during delivery. To do so, the customer must return the damaged items and enclose a copy of the invoice and a copy of a form for damaged goods, which is available at the post office. We will replace any damaged item with a new one as soon as possible.

A guarantee cannot be enforced:

  •                   if the items are not in their original packaging, except in cases described above,
  •                   if the colour of the glasses differs from the colour shown on the images displayed on the website,
  •                   if the items bought in the web store were used improperly and in contradiction with the manufacturer's instructions,
  •                   if the items were not bought in the web store Outlet optika.

 

Limitation of liability

The web store Outlet optika is committed to ensuring that the information contained on its website is up-to-date and accurate. Nevertheless, delivery times, product properties and other information may change too abruptly for us to make the necessary changes on our website in due time. In such cases we will contact the users and offer them a chance to cancel their concluded contracts or request an exchange.

Users are invited to submit their opinions and rate the articles offered in the web store. We will review all submitted opinions prior to their publication and exclude all abusive, improper, misleading or obviously untrue claims. Furthermore, Outlet optika cannot be held responsible for the remaining opinions.

Each customer must use the items sold in the web store Outlet optika in accordance with the manufacturer's instructions. Customers use the items bought at their own responsibility and are advised to consult an eye-care specialist beforehand. Outlet optika assumes no responsibility for the use of items ordered or for any consequences resulting from their use.

For the purposes of our business operations, we collect the following user data:

  •                   name and last name,
  •                   address and place of residence,
  •                   e-mail address, which is also used as a username,
  •                   contact telephone number,
  •                   password in encoded form,
  •                   and all remaining information entered by users into the forms contained in the web store Outlet optika.

 

We take no responsibility for the accuracy of the information provided by the users.

For security purposes we also collect the IP addresses of users accessing our website. For each user, a transient cookie is created upon visiting the website for identification and tracking of the shopping cart. Certain persistent cookies may also be saved on your computer: a user identification number in encoded form (for recognition upon the next visit), product ratings (to remember which products you have already rated) and four cookies from the Google Analytics system (analysis of website visits).

The information collected may be used by the operator or his potential successors exclusively for the purposes of their operations.

With the exception of the cookies, all aforementioned data are permanently saved on the server of the web store Outlet optika. Transient cookies are stored in the server memory only for the duration of the visit and are removed after one hour of inactivity, while persistent cookies are saved on the user's computer.

The data collected and processed will be disclosed only if legally required or in good faith that such action is necessary for proceedings before the courts or other government authorities and for the protection and pursuit of the legal interests of the web store Outlet optika.

 

Complaints and Disputes

Outlet optika acts in accordance with the applicable legislation on consumer protection. Outlet Optika shall make all possible efforts to fulfil its obligation to provide an effective system for processing complaints.

Outlet Optika is aware that the reluctance of consumers to initiate court proceedings to resolve disputes typically results from the disproportionality between the economic value of the claim and the time and costs required to resolve disputes. Therefore, Outlet Optika makes every possible effort to resolve disputes amicably and by common agreement.

 

In accordance with statutory norms, Optika Focus d.o.o. does not recognize any provider of out-of-court resolution of consumer disputes as competent to resolve any consumer disputes that may be initiated by a consumer in accordance with the Out-of-Court Resolution of Consumer Disputes Act.
